STANDARD TERMS AND CONDITIONS OF SALE 

 

1. Purpose of the contract

The purpose of this agreement is the rental of a scooter by Farang Rental Motorbike ("The Rental Agent") to the Hirer ("The Renter"), under the conditions defined below.

2. Conditions de location

2.1     Renter must be at least 18 years of age and possess a valid Thai or foreign driver's license.

2.2     A security deposit is required before the scooter is handed over and will be returned in its entirety only if all the general conditions of use have been respected.

2.3     The scooter is supplied with a set fuel level and must be returned at the same level.

3. Tenant Responsibilities

3.1     The Renter undertakes to use the scooter in a prudent manner and in accordance with the Thai Highway Code.

3.2     Any offence committed during the rental is the responsibility of the Tenant.

3.3     The Renter is responsible for any damage caused to the scooter except in cases of force majeure.

4. Insurance and damage

4.1     The scooter is covered by basic insurance. However, the damage caused by the Tenant's negligence remains at the Tenant's expense.

4.2     In the event of an accident, the Renter must immediately inform the Hirer and provide an accident report.

5. Return of the scooter

5.1     The scooter must be returned on the scheduled date and time.

5.2     Any delay will incur an additional fee, 50 baht per hour.

5.3     The Renter must return the scooter in its original condition. If not return as the same, under penalty of invoicing for the necessary repairs. The price will depend on the repair center's consideration.

5.4     Any liter of gasoline missing when returning the scooter will be charged 50 THB per liter.

5.5     In case of loss of the scooter key, a replacement fee of THB 1,500 will be applied.

5.6     A helmet returned damaged will incur a repair or replacement fee of 1 500THB

5.7     Any helmet in poor condition upon return will be charged according to the repair costs.

6. Cancellation and Termination

6.1     All cancellations must be reported at least 24 hours before the rental date.

6.2     The Rental Company reserves the right to terminate the contract in the event of non-compliance with these conditions.

7. Disputes

In the event of a dispute, the parties undertake to find an amicable solution. Otherwise, the competent courts in Bangkok will have the sole authority to decide the dispute.

3. ความรับผิดชอบของผู้เช่า

3.1     ผู้เช่าตกลงที่จะใช้สกู๊ตเตอร์อย่างรอบคอบและเป็นไปตามประมวลกฎหมายทางหลวงไทย

3.2     ความผิดใดๆ ที่เกิดขึ้นระหว่างการเช่าถือเป็นความ

รับผิดชอบของผู้เช่า

3.3     ผู้เช่าต้องรับผิดชอบต่อความเสียหายใดๆ ที่เกิดขึ้น

กับสกู๊ตเตอร์ ยกเว้นในกรณีที่เกิดเหตุสุดวิสัย

4. การประกันภัยและความเสียหาย

4.1     สกู๊ตเตอร์มีประกันขั้นพื้นฐานคุ้มครอง อย่างไรก็ตาม ความเสียหายที่เกิดจากความประมาทของผู้เช่า

ผู้เช่าจะต้องรับผิดชอบเองทั้งหมด

4.2     ในกรณีที่เกิดอุบัติเหตุ ผู้เช่าจะต้องแจ้งให้ผู้เช่าทราบ

และจัดทำรายงานอุบัติเหตุทันที

5. การคืนสกู๊ตเตอร์

5.1     ผู้เช่าจะต้องคืนสกู๊ตเตอร์ตามวันและเวลาที่กำหนด

5.2     หากผู้เช่าส่งคืนสกู๊ตเตอร์ช้ากว่ากำหนดจะต้องเสียค่าปรับ 50 บาทต่อชั่วโมง

5.3     ผู้เช่าจะต้องคืนสกู๊ตเตอร์ในสภาพเดิม หากไม่ส่งคืน

สภาพเดิม ผู้เช่าจะต้องชำระค่าซ่อมแซมเพิ่มเติม โดยราคาจะขึ้นอยู่กับการพิจารณาจากศูนย์ซ่อม

5.4     น้ํามันเบนซินที่ขาดหายไป เมื่อคืนสกู๊ตเตอร์จะถูกเรียกเก็บ

เงิน 50 บาทต่อลิตร

5.5     กรณีที่กุญแจสกู๊ตเตอร์สูญหาย จะมีการเรียกเก็บค่าธรรม

เนียมในการเปลี่ยน 1,500 บาท

5.6     หากหมวกกันน็อคที่ส่งคืนเสียหาย จะต้องเสียค่าซ่อมหรือ

เปลี่ยน 1,500 บาท

5.7     หมวกกันน็อคที่สภาพไม่ดีเมื่อส่งคืนจะถูกเรียกเก็บเงินตาม

6. การยกเลิกและการสิ้นสุด

6.2     บริษัทขอสงวนสิทธิ์ในการยกเลิกสัญญาในกรณีที่

7. ข้อพิพาท

ในกรณีที่เกิดข้อพิพาทขึ้น คู่สัญญาทั้งสองฝ่ายตกลงที่จะหา
